Probationary Review Procedures

  1. Annual Performance Evaluation--NOT Renewal of Contract

    1. Oversight Committee in department responsible for annual evaluation. (FPP 7.05 B)
    2. Required annual meeting with faculty member and with oversight committee representative(s) and department chair to discuss progress toward tenure. (FPP 7.05 C)
    3. Required annual review and discussion of evaluation by department Executive Committee. (FPP 7.05 C and D)
    4. Required annual written performance evaluation approved by the Executive Committee. (FPP 7.05 D)

  2. Review for Renewal of Contract-NOT Tenure Decision

    1. Must be done in time to provide the required notice if the contract is not renewed. (FPP 7.06 and UWS 3.09)

    2. Year of Service Required Notice of Nonrenewal
      First year of service No later than March 1
      Second year of service No later than December 15
      Two or more years of service At least 12 months in advance
    3. Department must provide notice of review to faculty member early in the semester proceeding the semester in which review will take place. (FPP 7.07 A)

    4. Faculty member has right to submit material for review and to attend the Executive Committee meeting. (FPP 7.07 A and B)

    5. Notice of date of meeting must be given more than 20 days prior to the meeting. (FPP 7.07 C)

    6. Executive Committee must notify faculty member of decision within 5 days. (FPP 7.07 D) Also notify Dean orally.

      1. Negative department decision: faculty member has 15 days to request statement of reasons. (FPP 7.07 E)
        1. Department has 30 days to provide statement. (FPP 7.08)
        2. Faculty member has 20 days to request reconsideration. (FPP 7.08)
        3. Reconsideration meeting must be held within 20 days. (FPP 7.08)
        4. Negative decision on reconsideration can be appealed to the Faculty Rights and Responsibilities Committee. (FPP 7.10)
      2. Positive department decision: department transmits to dean (FPP 7.09 A)
        1. Dean must notify department as rapidly as feasible of approval or disapproval. (FPP 7.09 A)
        2. Faculty member must be notified within 20 days of dean's decision. (FPP 7.09 A)
        3. If dean's decision is negative , within 20 days faculty member can request statement of reasons. (FPP 7.09B)
        4. Faculty member may meet with dean. (FPP 7.09B)
        5. Dean must issue a decision. (FPP 7.09B)
        6. If negative , faculty member can appeal to Faculty Rights and Responsibilities Committee. (FPP 7.10)

  3. Review of Contract for Renewal-Tenure Decision

    1. Criteria for tenure review must be developed by the department Executive Committee and given to probationary faculty member upon appointment. (FPP 7.14(D)
      1. Copy of the tenure criteria and a description of how they were applied to the candidate shall be forwarded with a departmental recommendation for tenure. (FPP 7.14 D)

    2. Procedures for review are same as those for review of renewal of contract, described above in section B. (FPP 7.15)
      1. Positive department recommendation: forwarded to dean (FPP7.15A)
        1. Department should allow 5 work days for Dean's office to review packet for completeness and to prepare a cover memo to send to the Divisional Executive Committee (CALS policy)

      2. Negative department decision: reconsideration and appeal process as described above if the result is nonrenewal of contract (FPP 7.10A)

    3. Dean consults with Divisional Executive Committee upon receipt of department recommendation (FPP 7.15B)
      1. Dean has the decision making authority; Divisional Committee is advisory.

      2. Dean prepares transmittal letter to the Divisional Committee; Department attaches letter to necessary copies of "dossier" and delivers dossiers to the Divisional Committee. (CALS policy)

    4. Divisional Committee provides advice to Dean
      1. Negative advice:
        1. Dean notifies Department Exec. Comm.
        2. Department Exec. Comm may request a meeting with the Divisional Exec. Comm (FPP 7.15 C)
        3. Div. Exec. Comm. will take a new vote (FPP 7.15 C)

      2. If advice from Divisional Committee upon reconsideration is still negative :
        1. Dean makes decision
        2. If dean's decision is positive , dean must forward to the provost a statement explaining the reasons for not accepting the Divisional Exec. Comm. recommendation (FPP 7.15 D2)
        3. If dean's decision is negative , dean must inform department (FPP 7.15 G)
          1. Department may request a statement of reasons
          2. Dean provides statement within 20 days
          3. Department may seek reconsideration by dean
          4. If dean's decision is negative , may be appealed to the Committee on Faculty Rights and Responsibilities if result is nonrenewal of appointment

      3. Positive advice from Divisional Committee
        1. Dean makes decision
        2. If dean's decision is positive , dean transmits approval to the provost with all supporting material and documentation and advice from the divisional committee. (FPP 7.15D1)
          1. Dean also informs department and faculty member
          2. Dean signs form from the Secretary of the Faculty
          3. If dean's decision is negative , see III (D)(2)(c) above

    5. Provost's Role
      1. Where the dean forwards a positive recommendation despite the negative advice from the Divisional Committee, the Provost shall consult with the Divisional Committee and the Dean (FPP 7.15 H)
      2. Where the provost makes a recommendation contrary to that of the dean (i.e. negative ), he/she shall consult with the dean. (FPP 7.15 H)
        1. The faculty member or the department may request a statement of reasons within 20 days (FPP 7.15 K)
        2. Faculty member or department may request reconsideration by Provost (FPP 7.15 K)
        3. If decision is negative, may be appealed to Committee on Faculty Rights and Responsibilities if result is nonrenewal of appointment (FPP 7.15K)

      3. Chancellor/provost notifies faculty member and department when the Board of Regents has approved tenure.
